Cahokia accident is subject of new suit

A couple has filed suit against the driver who they claim struck the vehicle in which they were riding.

David B. and Denise G. Cuppett claim Denise G. Cuppett was driving a vehicle north on Mississippi Avenue in Cahokia on Feb. 19, 2012, when defendant Barbara A. Barneko ran into her vehicle. At the time of the collision, David B. Cuppett was riding in the vehicle.

Because of the collision, the Cuppetts experienced disability and disfigurement, suffered great pain and mental anguish and lost earnings, according to the complaint filed July 20 in St. Clair County Circuit Court. They also incurred medical costs, the suit states.

The Cuppetts blame Barneko for causing the collision, saying she negligently failed to keep a proper lookout, failed to properly apply her brakes, failed to reduce her speed to avoid a collision, failed to stop and failed to yield.

In their complaint, the Cuppetts are seeking a judgment of more than $100,000, plus other relief the court deems just.
