Construction company sues insurers over numerous unpaid claims

A Belleville construction company is suing its insurance carriers for allegedly not paying on any of their property damage claims.

Westhaven Gardens Development Inc., Hidden Pearl Inc., Phillip Sheets Sr., individually, Sheets Enterprises Ltd. and Phillip L. Sheets Ltd. filed a lawsuit April 22 in St. Clair County Circuit against Pekin Insurance Company, PAC Inc. and Farmers Automobile Insurance Association. Pekin Life Insurance Company, doing business as Pekin Insurance, is also named as a defendant.

The plaintiffs have several pending claims against the defendants for property, hail and wind damage and others for vandalism, theft and miscellaneous issues, according to the complaint.

The claims are for numerous properties located in Freeburg, Belleville, East St. Louis, Fairview Heights and O'Fallon and include damages to construction trailers, machinery and vehicles.

The plaintiffs say they have made the premium payments on their policies and allege the insurance companies have refused to make any payments on any of their claims. They ask for a judgment equal to the value of their claims and costs of the lawsuit.

Attorney Bernard J. Ysursa of Belleville represents the plaintiffs.
