Motorcyclist counter-sues driver in East St. Louis accident

A man has countered a lawsuit originally filed against him, blaming a driver for striking his motorcycle.

David A. Wormald filed a counter lawsuit April 15 in St. Clair County Circuit Court against James E. Frazier Sr. and Crystal Wilkerson after Frazier originally filed a complaint against him.

Wormald claims he was driving a 2011 Harley Davidson east on Missouri Avenue near 15th Street in East St. Louis on April 21, 2012, at about 3:49 p.m. while Frazier was driving a 2008 Chevrolet Impala west on Missouri Avenue. At some point, in the middle of the intersection, Wormald’s and Frazier’s vehicles collided, according to the complaint.

Wormald blames Frazier for causing the collision, saying he attempted to turn left from Missouri Avenue onto 15th Street without yielding to Wormald’s motorcycle. Frazier negligently failed to keep his vehicle under proper control, failed to keep a proper lookout, failed to stop or take evasive measures to avoid colliding with his motorcycle, failed to yield the right-of-way and failed to give a proper signal when attempting to turn, the suit states.

In addition to Frazier, Wormald names Wilkerson as a defendant, saying she entrusted her vehicle to an inexperienced and incompetent driver.

Because of the collision, Wormald claims he suffered severe and permanent injuries, experienced physical and mental pain and anguish, incurred medical costs and lost wages.

In his complaint, Wormald seeks a judgment of more than $150,000, plus costs.
