Terra Properties fights woman's lawsuit over altercation

A property manager company being sued over altercation-related injuries sustained by a tenant says the woman’s injuries, if any, pre-existed before the alleged incident.

Michelle Waeckerle filed a lawsuit Feb. 4 in Madison County Circuit Court against Terra Properties, alleging she was attacked by another resident of the Suppinger Lane apartment complex in Highland - Wendy Masterson - in May 2012.

According to the complaint, Waeckerle and other residents had complained to Terra Properties several times about Masterson’s verbal and physical abuse.

Those complaints were allegedly never addressed by the property management company.

Waeckerle accuses Terra Properties of negligence for allegedly allowing a dangerous situation to continue by failing to evict Masterson.

Terra Properties denied the allegations in its April 19 response to the complaint. Terra Properties also requests the complaint be dismissed.

“Further answering, by way of affirmative defense, defendant states that plaintiff’s injuries, if any, pre-existed this incident.”

Waeckerle asks for more than $50,000 in damages for medical bills, lost wages and court fees.

The case is assigned to Madison County Chief Judge Ann Callis.
