St. Clair County is denying liability for injuries allegedly sustained by a prospective juror in March 2012.
Mary Kelley of Belleville filed suit against the St. Clair County Public Building Commission and St. Clair County on Feb. 13, claiming that while attempting to sit down in Courtroom 404 during jury selection, the seat collapsed. She claims she fell and hurt her neck and back and seeks at least $50,000 in damages.
Kelley accuses St. Clair County and the Public Building Commission of failing to maintain courthouse furniture.
Circuit Judge Vincent Lopinot has been assigned the case.
In its response filed March 8, St. Clair County Public Building Commission denies the allegations. It also states that Kelley was contributorily negligent, and any amount of judgment rendered against the defense should be reduced.
Attorney Kirk A. Caponi of Belleville represents Kelley.
Alvin Paulson of Becker, Paulson, Hoerner & Thompson in Belleville represents the defense.
