RDN Land Investment sues Swansea tenants

An investment company claims it lost more than $100,000 after its tenants failed to make their rental payments.

RDN Land Investment filed a lawsuit March 11 in St. Clair County Circuit Court against Duc Van Chu and Timothy S. Zickus.

In its complaint, RDN claims it leased property at 221 West Pointe Dr. Suite 1 in Swansea on March 16, 2011. The defendants guaranteed that they would make rental payments on the property, according to the complaint.

However, Chu and Zickus failed to make the agreed-upon payments and created disruptive sounds and vibrations that offended other tenants, the suit states.

“As of January 10, 2013, the amount of rent due and owing under the lease totaled $140,937.50,” the complaint says.

In its two-count complaint, RDN is seeking a judgment of more than $100,000, plus fees and costs and other relief the court deems just.

It will be represented by Daniel C. Nester and Christopher M. Blaesing of Bryan Cave in St. Louis.

St. Clair County Circuit Court case number: 13-L-131.
