Ardie & Tiny's sued over alleged drunken attack

The victim of an alleged assault at a Collinsville bar is suing the owner and the two men he claims got drunk and attacked him.
Robert D. Oberto II filed a complaint Feb. 27 in Madison County Circuit Court against Ardeth Lee Decker, individually and as owner of Ardie & Tiny's. David Anderson and Douglas Totty are also listed as defendants.
Decker owns Ardie & Tiny's, a bar on Joe Street in Collinsville, according to the complaint, and on Oct. 7, 2012, Anderson and Totty allegedly went to the bar and drank alcohol to the point of intoxication.

After the pair was intoxicated the men allegedly attacked Oberto by "repeatedly beating, kicking and stomping on him at Ardie & Tiny's," the complaints reads. Oberto says the assault caused extensive external and internal injuries to his head and body.

Oberto contends Decker and Ardie & Tiny's violated the Illinois Dram Shop Act by allegedly over-serving alcohol to Anderson and Totty. He says the two alleged attackers are also liable for their actions. Oberto is asking to be paid more than $100,000 for medical expenses, disability, disfigurement, pain and suffering.

Attorney Marc W. Parker of Maryville is representing Oberto.
