Woman says train accident forced her to quit job

In a recently filed court document, a woman claims she was forced to quit her job after a train hit her vehicle as she attempted to cross through a railway intersection.

Carmen Arriola filed a lawsuit Feb. 25 in Madison County Circuit Court against Kevin D. White, The Alton and Southern Railway Company and Norfolk Southern Railway Company.

In her complaint, Arriola claims she drove down the 6400 block of Collinsville Road in Fairmont on Feb. 24, 2012, when White, who was driving a train for Alton and Southern and Norfolk, struck Arriola’s vehicle as she passed through a railway intersection.

Because of the collision, Arriola’s vehicle was destroyed and she incurred medical costs and experienced pain and suffering, according to the complaint.

Arriola blames the defendants for causing her injuries, saying they failed to keep a proper lookout, failed to properly apply his brakes, failed to provide a warning of its impending approach and failed to lower the gate arms to protect the intersection.

In her complaint, Arriola seeks a judgment of more than $150,000, plus costs and other relief the court deems just.
