State sues man who fled DUI stop over trooper's injuries

The people of the state of Illinois have filed suit against the man who they claim ran away from the scene after he was suspected of driving under the influence.

Illinois Trooper Eric Heberer claims he had stopped defendant Nathan Yarbough near the intersection of 24th and State Streets in East St. Louis on Feb. 9, 2011, for the suspicion of driving under the influence.

Yarbough had climbed out of the vehicle he had been driving, and Heberer began performing field sobriety tests on him. Suddenly, Yarbough fled the scene of the traffic stop on foot, according to the complaint filed Feb. 8 in St. Clair County Circuit Court.

Heberer and other Illinois state police officers, including Trooper Brent Frey, attempted to find Yarbough, the suit states. While on the hunt, Frey slipped on some ice and suffered injuries to his right leg, the complaint says.

Because of the incident, the state of Illinois incurred costs to treat Frey’s injuries.

The people of the state of Illinois are seeking a judgment of more than $50,000, plus costs.

Val C. Simhauser of the Office of the Attorney General in Springfield and Thomas Soraghan of the Office of the Attorney General in Belleville will be representing them.
