Alton Lowe's sued over falling lumber incident

A man claims he was hurt by falling lumber in an Alton Lowe's store.
John S. Clark filed a negligence claim against Lowe's Companies Inc.on Feb. 11 in Madison County Circuit Court.

The alleged incident happened in May 2012 while Clark was shopping at the Lowe's on Homer Adams Parkway, according to the complaint. As he tried to move a single six-foot fence panel from a stack of nearly two dozen, Clark says the entire stack of lumber fell on top of him.

Clark claims Lowe's had an obligation to prevent him and other customers from being injured while in the store. He says the home improvement company is negligent for allegedly allowing the fencing material to be stacked too high.

Clark says the falling fence panels caused him to received permanent injuries to his neck, shoulder, back and leg. He is asking to be awarded more than $50,000 in damages for medical expenses and lost wages.
