Wal-Mart removes personal injury suit to federal court

Wal-Mart has removed a St. Clair County personal injury lawsuit involving a motorized cart to federal court.

Edna F. Allen claims she was visiting Wal-Mart at 1511 Camp Jackson Road in Cahokia, Nov. 1, 2010, when she was struck by a motorized cart.

Because of the incident, Allen claims she sustained left elbow, right hip, neck and back injuries; sustained serious pain and suffering; and incurred medical costs, according to the complaint filed last October.

The removal notice was filed Feb. 7.

Allen is seeking a judgment of more than $50,000, plus costs.

Wal-Mart denied the allegations in its Dec. 11 response.

Allen is represented by Brian S. McChesney and Craig M. Ortwerth of McChesney and Ortwerth in St. Louis.

Daniel L. Bradley and Rebecca L. Van Court of DeFranco & Bradley in Fairview Heights represent Wal-Mart.

The case was assigned to St. Clair County Circuit Judge Vincent Lopinot on Jan. 28.

St. Clair County Circuit Court case number: 12-L-584.
