In recently filed court documents, a man claims he sustained debilitating injuries in a head-on collision.
Gino Cappello filed a lawsuit Jan. 15 in St. Clair County Circuit Court against Jerry Bohnenstiehl.
In his complaint, Cappello alleges he drove north on Highway 4 near Lebanon when Bohnenstiehl, who was driving south on the same road, crossed the center lane and struck Cappello’s vehicle head-on.
In addition to his disabling injuries, Cappello suffered great pain and mental anguish; endured permanent injuries to his head, neck and back; and experienced an impaired ability to pursue his normal employment, according to the complaint. He also incurred medical costs, the suit states.
Cappello blames Bohnenstiehl for causing the collision, saying he negligently failed to keep a proper lookout, failed to drive at a safe speed, failed to keep his vehicle under proper control and failed to stay in his proper lane of traffic.
In his complaint, Cappello seeks a judgment of more than $50,000, plus costs.
Bruce R. Cook of Cook, Ysursa, Bartholomew, Brauer and Shevlin will be representing him.
