Madison County Circuit Judge Dennis Ruth on Jan. 28 continued a non-jury trial in a bank’s case against a couple who allegedly disconnected a sump pump and left basement windows open after the home was foreclosed.
First Collinsville Bank sued Dustin and Patricia Houseman Aug. 26, 2011, claiming the Housemans took out a $198,000 mortgage on April 6, 2006, at their home on 187 Holiday Dr. in Edwardsville.
The Housemans defaulted on their mortgage, and First Collinsville foreclosed on their home, according to the complaint.
The trial was scheduled Jan 29.
Ruth reset the case for a case management conference on Feb. 27.
Kevin Stine, the bank’s attorney, filed a motion to continue the bench trial, Jan. 24, stating he attempted to contact Patricia Houseman, but all telephone numbers are no longer good numbers.
In its complaint, First Collinsville Bank seeks a judgment of more than $50,000.
Ruth signed an order in November 2011, allowing defendant Patricia Houseman of Eldred, Ill., to defend herself as a poor person.
Kevin J. Stine of Mathis, Marifian and Richter represents the bank.
