St. Clair County Associate Judge Julie Katz on Jan. 24 dismissed a lawsuit against a man being blamed for causing the death of his wife.
Plaintiff’s attorney Deanna L. Litzenburg on Jan. 24 filed a stipulation for dismissal, stating the parties had settled their controversies.
St. Clair County Circuit Judge Vincent Lopinot had previously presided over the case.
Two years after his wife’s death, Harold Vitrey faced a lawsuit blaming him for causing the death of Thelma Vitrey.
Beverly Terveer filed suit against Harold Vitrey last month. She claimed Thelma Vitrey was a passenger in a vehicle Harold Vitrey drove on Dec. 2, 2010, when he lost control of the vehicle, skidded off the road, slid down an embankment and struck a tree.
Terveer is special administrator of Thelma Vitrey’s estate.
Terveer had claimed she lost Thelma Vitrey's companionship and society.
Harold Vitrey responded to the complaint Jan. 9, denying Terveer’s allegation and requesting that the court dismiss the complaint.
Terveer had sought a judgment of more than $50,000.
Deanna L. Litzenburg of Mathis, Marifian and Richter of Belleville represented the plaintiff.
Beth C. Boggs and Brent L. Salsbury represented the defense.
