Delivery driver claims injuries in Shop 'N Save forklift incident

A delivery driver says he was hurt by a forklift at an Alton Shop 'N Save.

Philip M. Hardy filed a lawsuit Dec. 21 in Madison County Circuit Court against Supervalu Inc., Supervalu Holdings Inc., Shop 'N Save Warehouse Foods Inc. and Shop 'N Save St. Louis Inc., all doing business as Shop 'N Save.

Hardy was delivering products to the Berkshire Boulevard Shop 'N Save in January 2011, according to the complaint,  when he was hit by a Shop 'N Save employee driving a forklift commonly called a "power jack." Hardy claims the tendons in his right ankle were torn in the incident.

Hardy accuses the defendants of negligence and seeks more than $200,000 in damages for medical expenses, loss of income and court fees.

He is represented by attorney James P. Leonard of St. Louis. They asks for a jury trial.
