Man injured in I-55 crash sues driver and rental car company

A man allegedly injured in a crash on I-55 is suing the driver and rental car company he says are responsible.

John S. Davidson Jr. filed a complaint against Mark Edward Miller and Barker Car Rental on Dec. 21 in Madison County Circuit Court.

The alleged crash happened the afternoon of June 1, 2012 on I-55 in Jarvis Township, according to the complaint. Davidson Jr. says he was driving his 2009 Chevrolet Silverado south on the interstate. Miller was allegedly driving a 2012 Ford Escape in the opposite direction. Near milepost 16, Davidson Jr. claims Miller "carelessly and negligently" drove the Ford into his lane and hit the Chevrolet.

Davidson Jr. accuses Miller of failing to stay within the proper lane of traffic, failing to control the vehicle's speed or apply the brake in order to avoid a collision. The Ford Escape was owned by Barker Car Rental, according to the petition.  Davidson Jr. says the company is, therefore, liable for injuries received in the crash.

Davidson Jr. says he "sustained painful and permanent injuries" and is asking to be awarded more than $50,000 from each defendant as compensation for medical expenses.

Attorney Randall A. Wolter of Wolter, Beeman & Lynch in Springfield is representing Davidson Jr. They ask for a jury trial.
