A St. Clair County woman is suing the makers of an osteoporosis medicine for allegedly making exaggerated claims of its benefits.
Claudia Hallmark a lawsuit against Merck Sharp & Dohme Corporation Nov. 15 in St. Clair County Circuit Court.
Hallmark says she was prescribed the drug Fosamax with the understanding that it would reduce the possibility of bone fractures. However, Hallmark alleges the drug does just the opposite by actually increasing the risk of injury.
She accuses Merck Sharp & Dohme of negligence, fraud, breach of implied warranty and knowingly putting a defective product on the market. Hallmark asks the drug manufacturer to pay more than $300,000 in damages, plus court fees, for allegedly making false claims.
