A Randolph County man says the Union Pacific Railroad Company is responsible for injuries he received from prolonged work on the job.
Samuel Dean Tidwell filed a lawsuit May 1 in St. Clair County Circuit Court against Union Pacific Railroad Company.
Tidwell says he worked as a conductor for UP during the month of May 2009. Tidwell says the job required him to operate track switches and hand brakes on a locomotive that were not well maintained or safe to use. He claims the repeated stresses of bending and twisting caused him to hurt his hips, right leg and lower back.
Tidwell accuses UP of negligence and of violating the Locomotive Inspection Act, the Safety Appliance Act and the Federal Employers' Liability Act. He is asking for more than $150,000 in damages to compensate for medical bills, loss of income and court costs.
Attorney William P. Gavin with Gavin Law Firm in Belleville is representing Tidwell.
