Rotator cuff torn in fall from wheelchair, suit claims

A man claims he sustained a tear in his rotator cuff after falling out of a wheelchair while living at a nursing home.

Hubbard Miller filed a lawsuit May 2 in Madison County Circuit Court against Stearns Property Company doing business as Stearns Nursing and Rehabilitation Center.

In his complaint, Miller alleges he was living at Stearns Nursing and Rehabilitation Center when he fell from his wheelchair while being left unattended.

In addition to his rotator cuff tear, Miller experienced great pain and suffering, lost his mobility and incurred medical costs because of the fall, the suit states.

Miller blames the nursing home for causing his fall, saying it negligently failed to provide adequate medical care and failed to provide supervision by leaving Miller unattended and unrestrained.

In his complaint, Miller seeks an unspecified judgment, plus costs, attorney's fees and other relief.
