Couple seeks $182K over unpaid loan

A New Athens man is accused of owing more than $182,000 to a St. Clair County couple after he allegedly failed to pay off a loan.

Louis and Tammy Birkner filed a lawsuit against Zachory Page on April 13 in St. Clair County Circuit Court.

The Birkners say they agreed to loan Page $100,000 in September 2007. The borrower agreed to pay back that entire amount plus interest by September 2008, according to the complaint. Page allegedly signed a contract promising he would make eleven monthly payments to the Birkners. However, the couple claims Page did not make his first payment until until March 2009.

The Birkners say the agreement signed by Page detailed contingencies for late payments and interest on any amount left unpaid past the final due date of September 2008. The couple accuses Page of breach of contract and asks for a judgement of more than $182,000 which includes the original principal and more than $82,000 in interest and late fees.

Attorney John G. Beseau of St. Louis is representing the Birkners.
