A couple has filed suit against the driver who they claim rear-ended their vehicle.
Deborah and Dennis Humphrey claim they were traveling south on Green Mount Road approaching its intersection with Interstate 64 on July 9, 2010, at about 7:13 p.m. when defendant Katherine Pocuca, who was also driving south, struck the rear of their vehicle.
Because of the collision, the Humphreys were made sick, sore, lame, disordered and disabled; suffered disability and disfigurement; and experienced paid and suffering, according to the complaint filed March 8 in St. Clair County Circuit Court. They also incurred medical costs and lost their earnings and their earning capacities, the suit states.
Pocuca negligently failed to keep a proper lookout, drove too fast, failed to decrease her speed to avoid a collision, failed to obey a traffic-control device, failed to drive within a single lane and failed to drive with adequate brakes, the complaint says.
In their two-count complaint, the Humphreys are seeking a judgment of more than $100,000, plus costs.
