Man sues two drivers who caused collision

A man has filed suit against the two drivers who he claims caused a collision.

Frank Hunter claims he was driving a 2007 Pontiac Torrent north on N. Main Street on Aug. 20 when he stopped to make a left-hand turn onto Water Street in Dupo.

At the same time, defendant Harry McGraw was attempting to make a left turn from Water Street onto N. Main Street, according to the complaint filed Sept. 16 in St. Clair County Circuit Court. In making the turn, McGraw caused co-defendant Joshua Constantine to strike Hunter's vehicle, the suit states.

Because of the collision, Hunter incurred severe injuries to his back, neck, head and chest and incurred medical costs, the complaint says. In addition, he claims he sustained great pain and mental anguish, sustained a disability, lost his normal life and missed numerous working days.

Hunter blames McGraw for causing the collision, saying he negligently failed to keep his vehicle under proper control, failed to keep a proper lookout, drove in an unsafe manner, failed to yield the right-of-way and failed to use evasive action to avoid the collision, among other negligent acts.

In addition to McGraw, Hunter names Constantine as a defendant, saying he negligently failed to keep his vehicle under proper control, drove in an unsafe manner, failed to use evasive action to avoid the collision, failed to reduce his speed to avoid the accident, failed to exercise due care and failed to pay proper attention to the traffic on the road, according to the complaint.

In his two-count complaint, Hunter is seeking a judgment of more than $100,000, plus costs.
