O'Fallon rear-end accident causes injuries, suit claims

A woman has filed suit against the driver who she claims rear-ended her, allegedly causing her to sustain injuries to her body and nervous system.

Yolanda L. Weddington claims she was driving a 2005 Chrysler Sebring east on West State Street near its intersection with Willow Street in O'Fallon on Aug. 13, 2009, at about 12:07 p.m. when defendant Sean P.M. Rawls, who was driving behind her, struck the rear of her vehicle.

In addition to her injuries, Weddington suffered physical and mental pain and anguish, incurred medical costs and suffered a damaged earning capacity, according to her complaint filed Aug. 10 in St. Clair County Circuit Court.

Rawls negligently failed to keep his vehicle under proper control, failed to keep a proper lookout, failed to stop or swerve to avoid a collision, drove without safe brakes, drove too fast and followed Weddington's vehicle too closely, the suit states.

In her complaint, Weddington is seeking a judgment of more than $50,000, plus costs.

She will be represented by Thomas B. Cannady of Cannady and AuBuchon in Belleville.
