Collinsville, AT&T and Berco sued over man's sidewalk trip

A Collinsville man wants to be paid more than $150,000 after falling in a hole in the sidewalk allegedly left by a construction company installing cable near his home.

Michael Deluca filed a lawsuit May 4 in Madison County Circuit Court against Berco Construction, AT&T and the City of Collinsville.

According to the complaint, Berco Construction was hired by AT&T and the City of Collinsville to install fiber optic lines on Spring Street. Deluca says in September 2010 he was walking in the area of the construction and stepped in a hole in the sidewalk allegedly left by Berco Construction crews. Deluca says he injured his knees during the fall.

Deluca accuses Berco, AT&T and the City of Collinsville of negligence for not filling in the hole and for failing to warn people of the danger created by the missing section of concrete. He is asking for more than $150,000 in damages for medical expenses, lost wages and court costs.

Deluca is represented by attorney Nathan C. Lanter of Belleville.
