Hylla approves settlement of tow-truck wrongful death suit

A woman's wrongful death suit filed over the deaths of her husband and infant son in a tow-truck accident is over.

Madison County Circuit Judge David Hylla entered the final approval of the confidential settlement between Jessica Legens, Regions Bank and all of the defendants in her 2008 suit on Feb. 15.

Jessica Legens sued tow truck driver Mark Ikerman, his employer Mannheim Services Corporation, the owners of Sparky's Pub 397 and Mac & Mick's Sports Bar and Grill for damages in excess of $50,000. There was also a move to add punitive damages to the suit at one time.

Jessica Legens sued along with Regions Bank as the administrators of the estates of Donald Legens Sr. and Jr.

According to the suit, Ikerman had been drinking at the two bars before he answered a tow call placed by Donald Legens Sr.

Donald Legens Jr. was a passenger in his father's car which had run out of gas.

Ikerman's tow truck allegedly hit the Legens car, pushing it into Donald Legens Sr. who was outside of the vehicle.

Donald Legens Sr. died on the night of the accident.

His nine month-old son died shortly after from his injuries.

The plaintiffs contended that the bars sold Ikerman the alcohol that led to the crash.

They sued Mannheim as Ikerman's employer.

Ikerman also faces criminal charges in connection with the incident.

According to Hylla's order, the settlement terms have been filed under seal to protect the interests of other minor children with claims on the settlement's proceeds.

The order also appointed a number of attorneys as guardians ad litem for those minor children.

The attorneys are Erin Reilly, Bob Perica, David Jones, Phil Theis, Kevin Babb, Jeffrey Ezra, Amy Sholar and Michael Glisson.

Jessica Ellen Legens' attorneys are Kevin Davidson and H. Lynn Henry.

Edward Aucoin and Donald O'Meara of Chicago represent Mannheim.

Joel Groenewold of Chicago represents Mark Ikerman. He is
represented in the criminal matter by Edward Unsell.

Ralph Derango represents Mac & Mick's Sports Bar and Grill Inc.
Daniel Hasenstab represents Mark and Mary Eddleman, the owners of Sparky's 397 Pub.

The case is Madison case number 08-L-1113.
