Cahokia accident is subject of suit

A woman has filed suit against the driver who she claims struck her after failing to come to a stop at a traffic control device.

Felicia C. Rush-Taylor claims she was driving north on Paris Avenue near Pontiac Avenue in Cahokia on May 6 when defendant Marlene F. Albert, who was driving west on Cahokia, was unable to stop her vehicle at a stop sign and collided with Rush-Taylor.

Because of the collision, Rush-Taylor was tossed inside her vehicle, suffered injuries and pain and incurred medical costs, according to the complaint filed Jan. 10 in St. Clair County Circuit Court. In addition, she lost earnings and sustained an impaired earning capacity, the suit states.

Albert negligently failed to maintain a proper lookout, drove too fast, drove without adequate brakes, failed to properly apply her brakes, failed to drive with a working horn, failed to yield the right-of-way, failed to keep her vehicle under control and failed to stop at a stop sign, the complaint says.

In her complaint, Rush-Taylor is seeking a judgment of more than $50,000, plus costs.

Rush-Taylor will be represented by Chris Kolker of Kolker Law Offices in Belleville.

St. Clair County Circuit Court case number: 11-L-16.
