The approval of a settlement over the deaths of a man and his infant son in a 2008 Granite City tow truck accident has been continued.

A hearing on the settlement between Jessica Ellen Legens, Regions Bank, and all of the defendants in the wrongful death case was pushed back to 1:30 p.m. on Feb. 10.

Madison County Circuit Judge David Hylla had been set to hear arguments in favor of the settlement's approval today at 1:30 p.m.

Jessica Ellen Legens and the bank sued tow truck driver Mark Ikerman, Mannheim Services Corporation, Mac & Mick's Sport Bar and Grill, and Mark and Mary Eddleman, the owners of Sparky's Pub 397.

The plaintiffs sued in 2008 as the administrators of the estate of Donald Legens Sr. and his son, nine month-old Donald Legens Jr.

They alleged that Ikerman had been drinking at the two bars when he drove his tow truck into the car Donald Legens Jr. was a passenger in.

The car was pushed into his father who was outside the vehicle.

Donald Legens Sr. died on the night of the accident.

His son died shortly after from his injuries.

Mannheim employed Ikerman.

Ikerman faces criminal charges in connection with the accident.

The plaintiffs had sought at least $50,000 in damages per count of
the suit and at one time moved to add punitive damages to the case.

All of the parties eventually entered into a confidential settlement.

There is no indication in the court schedule as to why the hearing was moved.

All of the defendants are included in the settlement.

Jean Maguire and David Zevan represent Jessica Legens.

Joel Groenewold represents Ikerman.

Edward Aucoin and Donald O'Meara represent Mannheim.

Ralph Derango represents Mac & Mick's.

Daniel Hasenstab represents the Eddlemans.

Donald Legens Jr.'s grandparents are represented by Troy Walton. They are not parties to the case.

Attorney Michael Glisson was recently appointed to act in the interests of all the minors in the case.

The case is Madison case number 08-L-1113.
