Matoesian finds defendants in Locklear Electric class action in default

Two defendants in one of a series of class actions filed over faxed advertisements are in default, according to an order signed by a Madison County judge.

Madison County Circuit Judge Andreas Matoesian on Dec. 10 granted a request by plaintiff Locklear Electric of Wood River to find defendants in default.

Neither defendant Christopher Parks nor American Business Lending entered an appearance in the case despite service.

A hearing on damages in the case remains to be set.

No class was certified in the case.

Locklear has filed a number of class actions over faxed advertisements in both Madison and St. Clair counties.

While several have either ended or been taken to federal court, another suit against Taylorville Chiropractic Clinic of Florissant, Mo. remains active.

Larry Darr represents Locklear in the case at hand.

No attorneys are listed for the defendants.

The case is Madison case number 08-L-1131.
