Stearns Nursing Center allegedly allowed resident to fall

The administrator of a deceased man's estate claims a nursing home contributed to the man's death by allowing him to fall numerous times during his first day at the facility.

James Mang filed a lawsuit Aug. 30 in Madison County Circuit Court against Stearns Nursing and Rehabilitation Center.

James Mang claims Bernard Mang became a patient at Stearns on May 26, 2009.

It did not take long after Bernard Mang's admittance to the nursing home before he fell three to four times during his initial 24-hours at the facility, the complaint says.

The multiple falls caused Bernard Mang to sustain a broken neck and to experience pain and suffering before his death on May 30, 2009, the suit states.

James Mang blames Stearns for causing Bernard Mang's death, saying the facility negligently failed to supervise Bernard Mang, allowing him to fall, and failed to protect Bernard Mang from falling.

In his two-count complaint, James Mang seeks a judgment of more than $100,000, plus attorneys' fees and costs.

Eric J. Carlson of Byron, Carlson, Petri and Kalb in Edwardsville will be representing him.
