Judge allows exhibits into case in weight loss surgery suit, status set for August

St. Clair County Circuit Judge Robert Lechien has allowed the plaintiff in a suit against St. Clair County over weight loss surgery to enter two exhibits bolstering her case.

Lechien also set the case for a status conference in August.

Plaintiff Tisa Gartney alleges that her county health plan failed to pay for her gastric banding surgery in July 2006.

The surgery is meant to promote weight loss.

She seeks damages of at least $33,000.

St. Clair County denies the claims laid out in the suit.

The two exhibits consist of a letter from Gartney's insurer while the other document relates to the actual surgery.

The letter from Benefit Administration Systems Ltd., written June 27, 2006 indicates that the surgery was covered by Gartney's plan.

Lechien's order also sets a status conference Aug. 3 at 9:30 a.m.

Gartney is represented by Kevin Boyne.

The county is represented by Alvin Paulson.

The case is St. Clair case number 09-L-151.
