Alton attorney's fee issue set for hearing in Rosewood negligence case

Madison County Circuit Judge Andy Matoesian will hear an Alton attorney's request for $87,625 in fees in a case against an Alton nursing home.

Attorney Clifford Emons already had been awarded $15,000 from Hovan Services of Alton, formerly Rosewood Care Center of Alton, last September as special administrator of nursing home resident Jane Schwarz.

Jurors in the case found that the nursing home violated the state's Nursing Home Care Act in failing to care for Schwarz.

Emons also is asking for costs of $11,943.82.

The hearing is set for June 2 at 11 a.m.

In the Oct. 21, 2009 motion for fees, Emons claims to have worked 350.5 hours on the case at $250 per hour.

Emons also filed a motion earlier this year asking Matoesian to amend the Sept. 22, 2009 judgment to correct the defendant's name.

Emons is represented by Doug Mendenhall of Alton.

The defendant is represented by Dennis McCubbin.

The case is Madison case number 04-L-535.
