Ruth stays proceedings in sexual harassment suit

Ruth

A sexual harassment suit is on hold in Madison County as its parties await a state commission's ruling.

Madison County Circuit Judge Dennis Ruth stayed proceedings in the suit brought by plaintiff Colleen Vesper until the Illinois Human Rights Commission can rule on her sexual harassment complaints.

The defendants in the suit, Gary Moore and the Illinois Thoroughbred Breeders and Owners Foundation, had asked Ruth to throw out the suit because Vesper had not filed her claims with the human rights office.

Vesper is suing Moore and the Foundation alleging that Moore made her work in a hostile environment after she refused his romantic advances.

Vesper had been the business manager of Fairmount Park until she lost her job last year.

She is seeking damages in excess of $30,000 and attorney's fees.

The April 30 hearing on the motion to dismiss was set after it had been pushed off several times this year.

Vesper is represented by Stephen McGlynn.

The defendants are represented by Steven Schwartz.

The case is Madison case number 09-L-1021.
