A man has filed suit against the driver who he claims rear-ended him on the interstate.
Donald R. Maine II claims he was driving on the Interstate 55/70 westbound exit ramp about 229 feet west of Illinois Route 159 in Collinsville on Dec. 15 when defendant Tobey Jane Elvers, who was driving in the same direction, struck the rear of his vehicle.
Because of the accident, Maine was made sick, sore, lame, disordered and disabled; suffered injuries to his neck, shoulder and back; and incurred medical costs, according to the complaint filed May 10 in Madison County Circuit Court. In addition, he suffered disability, experienced pain and suffering and lost wages, the suit states.
Elvers negligently failed to keep a proper lookout, drove in such a manner that she struck the rear of Maine's, failed to properly apply her brakes, drove too fast and followed Maine's vehicle too closely, the complaint says.
In his complaint, Maine is seeking a judgment of more than $50,000, plus costs.
Thomas C. Rich and Kristina D. Cooksey of Fairview Heights will be representing him.
