A Belleville man has filed suit against the driver who he claims crashed into his vehicle after failing to yield the right-of-way to him.
Stephen C. Mather claims he was driving east on Illinois 177 in Mascoutah on Dec. 3, 2008, at about 7:40 a.m. when defendant Sherry A. Heuer, who was driving north on Rentchler Station Road near its intersection with Illinois 177, attempted to make a left turn and crashed into Mather.
"That defendant failed to yield to the stop sign and oncoming traffic, which resulted in defendant striking plaintiff's vehicle," the suit filed May 5 in St. Clair County Circuit Court states.
Because of the collision, Mather was made sick, sore, lame, disordered and disabled; suffered severe pain and anguish; and incurred medical costs, according to the complaint.
Heuer negligently failed to keep a proper lookout, failed to follow traffic signs on the road, failed to exercise a reasonable awareness of her surroundings and failed to avoid an accident when she had the opportunity to do so, the complaint says.
In his complaint, Mather seeks a judgment of more than $50,000, plus costs.
