Regions Bank sues over undelivered RV

A bank has filed suit against a car company that it claims failed to deliver a specially made vehicle to a disabled adult despite a significant down payment.

Regions Bank, guardian of the estate of Brandon Shamble, claims Howard RV Supercenter agreed to sell a 2008 Itasca Sunrise RV to Regions Bank. The RV was to be specially designed to accommodate Shamble, and so, Howard RV Supercenter requested a check for half of the amount of vehicle's purchase price or $80,877, according to the complaint filed April 30 in St. Clair County Circuit Court.

Regions Bank paid the money to Howard RV Supercenter, who then forwarded the payment to defendant Winnebago Industries, the vehicle's manufacturer, the suit states.

"Despite the check being tendered and cashed, the 2008 Itasca Sunrise RV was never delivered to Plaintiff, nor was any money refunded to Plaintiff," the complaint says. "Defendant has unjustly retained a benefit to the detriment of Plaintiff."

In its complaint, Regions Bank is seeking a judgment of more than $50,000, plus attorney's fees, costs and other relief the court deems just.

It will be represented by Misty L. Wuebbels of Blake and Allen in Belleville.
