Route 159 accident is subject of suit

A Madison County woman and her husband have filed suit against the driver who they say rear-ended the woman after he failed to slow his vehicle as she turned in front of him.

Donna and Billy Taylor claim Donna Taylor turned south onto Illinois Route 159 near its intersection with Tranquility Ridge in Edwardsville on July 11, 2008, when defendant Jacob Rose, who was driving south on Illinois Route 159, struck Donna Taylor from behind.

Because of the collision, Donna Taylor sustained injuries to her back; suffered great pain of her mind and body; endured mental anguish; incurred medical costs; is unable to attend to the normal affairs of her life; and lost wages, according to the complaint filed April 30 in Madison County Circuit Court. In addition, Billy Taylor lost his wife's support, society and consortium, the complaint says.

Rose negligently failed to drive at a proper speed, failed to decrease his speed to avoid a collision, failed to maintain proper control of his vehicle and failed to maintain a proper lookout, the suit states.

In their two-count complaint, the Taylors are seeking a judgment of more than $100,000, plus costs.
