Parties in Madison house fire case file settlement stipulations

The parties in a Madison house fire suit that had been set for trial in April have filed their settlement stipulations.

Plaintiff Leroy Latham's suit against Yvett Osuegbu settled just before it was set to open for trial April 12.

Latham sued Osuegbu, his neighbor, and Adeaza Demolition for allegedly damaging his property. He contended that a fire that began at Osuegbu's neighboring property spread and destroyed his home in March 2006, causing at least $115,000 in damage.

Osuegbu denied that she was responsible for the claims.

Adeaza was dismissed without prejudice from the case in February.

The amount of the settlement is not apparent in the May 4 stipulations.

According to the stipulations, each party will bear their own costs.

The settlement dismisses the suit with prejudice.

Latham is represented by Scott Bjorseth of Alton.

Osuegbu is represented by Joseph Bleyer of Marion.

The case is assigned to Madison County Circuit Judge Barbara Crowder.

Madison County Circuit Judge Dennis Ruth had been set to preside over the April 12 trial due to Crowder's schedule.

The case is Madison case number 08-L-663.
