Suit over head injury on bus set for trial Monday

A man's suit against the Agency for Community Transit over a head injury is set for trial Monday.

Plaintiff Richard Dermott claims that the bus's driver drove too fast over a bump in the road in Granite City three years ago.

Dermott claims he hit his head on the ceiling of the bus due to the jolt.

He seeks damages of at least $50,000 and costs.

Dermott's suit originally named Madison County Transit as a defendant. The Agency for Community Transit was substituted for that body in April 2009.

Madison County Transit had leased the buses to the substituted, defendant according to the case records.

The trial is set to open at 9 a.m.

Madison County Circuit Judge David Hylla is presiding.

Dermott is represented by Richard Reed of Belleville.

The defendant is represented by Donald Ohl of Edwardsville.

The case is Madison case number 08-L-525.
