Rear-end accident causes injuries, suit claims

A man has filed suit against the driver who he claims failed to stop for his slowing vehicle and rear-ended him.

Charles E. Atwood claims he was driving east on the 400 block of St. Louis Road in Madison County on Oct. 29 when defendant Danielle B. Donaldson, who was driving behind him, failed to stop as Atwood slowed for a vehicle turning south onto Bond Street. As a result, Donaldson struck the rear of Atwood's vehicle, according to the complaint filed April 19 in Madison County Circuit Court.

Because of the accident, Atwood suffered severe and disabling injuries to his ankle, leg and body; suffered great pain and mental anguish; incurred medical costs; and lost large sums of money because of his inability to pursue his normal occupation, the suit states.

Donaldson negligently failed to stop to avoid a collision, drove too fast, failed to keep a proper lookout for other vehicles on the road and failed to keep her vehicle under proper control, the complaint says.

In his complaint, Atwood is seeking a judgment of more than $50,000.

He will be represented by Matthew A. Marison of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville.
