Hearing set in weight loss surgery suit against St. Clair County

A hearing is set Wednesday in a suit against St. Clair County brought by a woman who claims it failed to pay for her weight loss surgery.

Plaintiff Tisa Gartney is asking to submit two exhibits, a letter stating her surgery was covered by her St. Clair County insurance plan and a document related to her surgery.

The hearing is set for 9:30 a.m. before St. Clair County Circuit Judge Robert LeChien.

The first exhibit, a letter from Benefit Administration Systems Ltd., written June 27, 2006 states that Gartney's gastric band surgery was covered under her insurance.

Gartney is suing the county for allegedly failing to reimburse her for the July 2006 surgery.

Her suit asks for damages of at least $33,000.

St. Clair County denies the claims laid out in her 2009 complaint.

The plaintiff is represented by Kevin Boyne.

St. Clair County is represented by Alvin Paulson.

The case is St. Clair case number 09-L-151.
