Budnick Converting Inc. filed a lawsuit Feb. 19 in St. Clair County Circuit Court against Big Jimmy's Distributing of Ohio, claiming it failed to reimburse it for $70,000 worth of merchandise.
Budnick claims Big Jimmy's executed a credit application with it on May 6.
Under an open account, Budnick distributed merchandise to Big Jimmy's with the understanding that the company would pay it back, according to the complaint.
However, Big Jimmy's has not paid for the merchandise, the suit states.
"Defendant owes Plaintiff the principal sum of $71,314.44," the complaint says.
In addition to the money it says Big Jimmy's owes it, Budnick seeks pre-judgment interest, costs, attorneys' fees and other relief the court deems just.
Deanna L. Litzenburg and Laura E. Craft of Mathis, Marifian, Richter and Grandy in Belleville will be representing it.
St. Clair County Circuit Court case number: 10-L-78.
