Bethalto pharmacy sued over unpaid note

A corporation claims a Bethalto pharmacy owes it more than $250,000 in unpaid debts.

McKesson Corporation filed a lawsuit Feb. 17 in Madison County Circuit Court against Barton Pharmacies and Joseph D. Barton.

McKesson claims Barton Pharmacies owes it $56,668.81 for goods and merchandise it purchased between Nov. 9 and Dec. 8.

McKesson also claims Barton remains indebted to it for a note worth $312,516.19 it executed on Jan. 7, 2009. Since the note's execution, Barton has paid off $92,785.44, but still owes McKesson $219,730.75, plus interest at 7.25 percent per annum.

In addition to Barton, McKesson names Joseph D. Barton as a defendant because he executed an individual guaranty on the Jan. 7 note. However, like Barton, Joseph D. Barton, has failed to make requested payments on the note, according to the complaint.

In addition to the money it says Barton Pharmacies and Jospeh D. Barton owe it, McKesson seeks court costs, attorney's fees and other relief the court deems just.
