Godfrey accident results in injuries and lawsuit

A man claims he suffered extensive injuries to his lower back after a driver failed to obey a traffic control device and crashed into him.

Bruce Bayer filed a lawsuit Feb. 16 in Madison County Circuit Court against Rachel Lowe.

Bayer claims he drove a 2006 Chevrolet east on West Delmar Avenue at its intersection with Pierce Lane in Godfrey on Jan. 11, 2009, at about 3 p.m. when Lowe, who drove a 2003 Oldsmobile in the same direction, collided with him.

In addition to his back injuries, Bayer was made sick, sore, lame and disordered; incurred medical costs; experienced pain and suffering; lost wages; lost his earning capacity; and suffered disability and disfigurement, according to the complaint.

He blames Lowe for causing the accident, saying she negligently failed to reduce her speed to avoid a collision, drove too fast, failed to brake or swerve to avoid a collision, failed to keep a proper lookout and failed to obey a traffic signal.

Bayer seeks a judgment of more than $50,000, plus costs and other relief the court deems just.
