Breach of contract trial continues with case management in February

A breach of contract case that had been slated to open in a bench trial Monday morning will continue with a case management conference next month.

A new trial date has not been set as yet.

Madison County Circuit Judge Barbara Crowder had been set to hear the case at 9 a.m.

The conference will be held Feb. 24 at 9 a.m.

The defendant in the case, PA Ted Spring Company, had filed a motion to move the Jan. 25 non-jury trial earlier this month, citing continued discovery problems and deposition issues due to winter weather.

The suit was brought by AMG Sales Inc. of Edwardsville against PA Ted Spring for breach of contract and violations of the Illinois Sales Representative Act.

According to its complaint, PA Ted Spring failed to pay the Edwardsville company $45,000 in back commissions after it ended the company's contract and extended the termination period.

PA Ted Spring claims it does not owe the money.

AMG is seeking damages of $45,000, attorney's fees and other damages. It is represented by Donald Ohl.

PA Ted Spring is represented by Mary Gardner.
