Pre-trial set Dec. 3 in Pontoon Beach car accident suit

Madison County Circuit Judge Daniel Stack is scheduled to oversee the pre-trial hearing of a Pontoon Beach car accident suit and its counterclaims next week.

The hearing is scheduled for Dec. 3 at 9:30 a.m.

The original complaint stems from a September 2005 car crash and was filed by the passenger in one of the vehicles.

In the original complaint, plaintiff Caleb Soben sued both the driver of the car he was riding in, Gregory Stearnes and driver Todd Horvath. Soben alleges that Horvath failed to keep a look out, was speeding, and was not driving in the proper lane when he collided with Stearnes. Soben further contends that Stearns failed to keep a proper look out, failed to avoid the collision and also drove improperly.

Soben's suit seeks damages of at least $50,000 and costs for his injuries.

Stearnes filed a claim for contribution against Horvath. He denies that he was responsible for the accident and, if found liable, wants Horvath to contribute to his costs.

Soben is represented by Curtis Blood of Collinsville.

Stearnes is represented by Gary Wiseman of St. Louis.

Horvath is represented by David Hesi of St. Louis.

The case is Madison case number 07-L-558.
