Third suit filed against Diocese over leased equipment default

A lawsuit filed by a Wabash bank marks the third complaint against the Roman Catholic Diocese of Springfield for leased equipment it allegedly defaulted on.

Crossroads Bank filed a lawsuit Nov. 9 in Madison County Circuit Court against the diocese.

The bank claims the diocese entered into an equipment finance contract with National Equipment Leasing on Nov. 24, 2008.

"The Defendant stands in default of the terms and provisions of the Equipment Finance contract in that it has failed and refused to make the installment payments of principal and interest inquired thereby," the suit states.

In the complaint, Crossroads seeks a judgment of more than $50,000, plus pre-judgment interest, attorney's fees and costs.

Donald L. Metzger of Metzger Law Offices in Edwardsville will be representing it.

Madison County Circuit Court case number: 09-L-1207.
