The mother of a minor boy and another woman have filed suit against the driver who they claim rear-ended a vehicle.
Ella Pettiford and Felicia Pettiford filed a lawsuit individually and on behalf of Felicia Pettiford's minor son, Xavier Hall, on Nov. 13 in St. Clair County Circuit Court against Kacie Moore.
The Pettifords claim Xavier Hall was riding in a car Ella Pettiford was driving south on Flanagan Road/Frank Scott Parkway about 503 feet east of its intersection with Ida Road on April 3.
Suddenly, Kacie Moore, who was driving a 2007 Pontiac Torrent in the same direction, rear-ended the car Ella Pettiford was driving, according to the complaint.
Because of the accident, Hall suffered injuries to his neck, back, abdomen and head, sustained great mental anguish and incurred disability. In addition, he lost his normal life and has missed extracurricular and physical activities, the suit states.
Ella Pettiford claims she, also, suffered injuries to her neck, back and head, sustained great pain and mental anguish, incurred disability, lost her normal life and missed numerous working days.
Felicia Pettiford says she has incurred medical costs due to her son's injuries.
The Pettifords blame Moore for failing to keep her vehicle under proper control, for failing to take evasive action to avoid an accident, for failing to maintain a proper lookout, for failing to apply her brakes, for driving in an unsafe manner and for failing to reduce her speed to avoid a collision.
In the three-count suit, the Pettifords are seeking a judgment of more than $100,000, plus costs and medical costs incurred.
