Pre-trial scheduled next week for legal malpractice suit

A pre-trial hearing is set Tuesday in a legal malpractice suit that is scheduled to take up two weeks in Judge David Hylla's courtroom in December.

The case is a 2004 malpractice lawsuit brought by Dr. Rocco Marrese against Gundlach, Lee, Eggman, Boyle & Roessler.

The complaint and details of the case were not immediately available in the court file, but according to a previous report in the Record, Marrese, an orthopedic surgeon, lawyer and expert witness, sued the defense firm Jan. 23, 2004, after a Madison County jury returned a $1.8 million verdict against Marrese in a medical malpractice trial.

Marrese claims he must saftify $874,000 of the judgment because his insurance carrier only paid $1 million.

According to the court docket, Hylla has the trial slotted for two weeks beginning Dec.7.

According to the case file, the case had previously gone for mediation in 2007.

The hearing is scheduled to begin at 10 a.m. Nov. 24.

Marrese is represented by Glenn Bradford.

The defendant is represented by Brent Baldwin.

The case is Madison case number 04-L-082.
