Plaintiff moves to continue Wentzville, Mo. accident suit

The plaintiff in a suit stemming from a 1999 accident in Wentzville, Mo. is asking for a continuance in her Madison County lawsuit.

Plaintiff Sherri Pate filed her motion to continue Oct. 27. She is suing Patricia Dieu for damages in excess of $50,000, punitive damages, costs and attorneys' fees.

Pate alleges Dieu is responsible for injuries Pate sustained in an August 1999 car accident.

The case is set for trial Nov. 2. It has previously been dismissed without prejudice and several trial settings have been continued.

Circuit Judge Andy Matoesian is presiding.

A copy of the motion to continue was not available in the case file.

According to the complaint, Pate was a passenger in Dieu's car as the pair drove west along Interstate 70 near Wentzville, Mo. They were pulling a trailer behind their vehicle.

Pate alleges Dieu failed to keep lookout, failed to reduce her speed in a construction zone, drove too fast and did not know how to drive while pulling a trailer. The car then flipped and rolled, causing Pate severe injuries.

Pate claims her earning power has been reduced, she has suffered mental anguish, incurred medical bills and has lost income.

Pate is represented by Michael Reid.

Dieu is represented by William Starnes II.

The case is Madison case number 06-L-861.
