Parked car accident results in man's injuries

A Madison County man says his neck and back were severely injured after a woman collided into his parked car.

Scott Muir filed a lawsuit Sept. 21 in Madison County Circuit Court against Erica Hartwig, Daniel Hartwig and Cynthia Hartwig.

Muir claims his 1993 Ford Escort was parked on Mill Street in Collinsville on Oct. 14, 2007, when Erica Hartwig, who was driving a 2005 Chevrolet Cobalt on Mill Street, collided violently with Muir's parked vehicle.

Before the accident, Daniel and Cynthia Hartwig had lent the Chevrolet to Erica Hartwig, according to the complaint.

In addition to his injuries, Muir was prevented from attending to his usual duties and affairs, lost large sums of money and incurred medical costs, according to the complaint.

He blames Erica Hartwig for driving too fast, for failing to decrease her speed to avoid a collision, for failing to keep her vehicle under proper control, for failing to see Muir's vehicle, for failing to alter her direction and for failing to keep a proper lookout.

Daniel and Cynthia Hartwig were negligent in their entrustment of their vehicle to Erica Hartwig, the suit states.

In the four-count suit, Muir is seeking a judgment of more than $200,000, plus costs and other relief the court deems just.
